Moldova's Court of Accounts reports non-compliances in carrying out public procurements at Defence Ministry

Chisinau, 30 July /MOLDPRES/ - The public procurements carried out at the Defence Ministry’s system in 2019-2020 did not fully meet the fundamental principles which govern this sector, according to a report by the Court of Accounts, published in the Official Journal (Monitorul Official) from 30 July.      

“The inexistence of an internal unified regulatory framework, which would regulate the way public procurements are organized and carried out at the Defence Ministry’s system, the improper regulation of the activity of working groups for  procurements at the contracting authorities, the bad quality of planning public procurements, insufficient justification of the abnormally low bids etc. represent the main problematic aspects identified by the audit,’’ the document shows.   

At the same time, the audit showed gaps and non-correlations of the normative framework related to the field of public acquisitions, such as: some legal provisions are not adjusted to the underlying framework; the regulations applicable to the low-value procurements are ambiguous and incomplete; Finance Ministry’s orders are not correlated with the government decisions in the aspect defining the public capital investments and capital repairs; the shares used at the elaboration of the spending sheet for procurements and works, established by the Economics and Infrastructure Ministry, allow the exaggerated planning of the budgetary resources needed; the model of the framework contract for the public procurements of works, approved by the Finance Ministry, does not ensure the connection between the procedure of nominating the winner and the contract signed.  

The report was submitted to the Presidency, Parliament, Government, Economics and Infrastructure Ministry, Finance Ministry and the Agency for Public Procurements, Defence Ministry and the institutions subordinated.  

The decision entered into force on the date of its publication in Moldova’s Official Journal and can be appealed with a preliminary application to the issuing authority in a 30-day period after the publication date.
