Law on selection, performance evaluation, career of judges to be amended

Chisinau, Feb. 23 / MOLDPRES /- Cabinet today approved amendment to the Law on selection, performance evaluation and career of judges, the government's communication and protocol department has reported.
More specifically, it concerns the exclusion of the rule which provides for the obligation to carry out an extraordinary assessment of the performance of judges in the event that they are to be appointed until they reach the age limit. Thus, judges whose five-year term has already expired or will expire by April 1, 2022 will have the opportunity to be appointed until they reach the age limit based on the ordinary evaluation, conducted every three years.
"The purpose of this project is to synchronize the legal provisions with the constitutional amendments regarding the judicial system, operated in 2021, and which will enter into force on April 1, 2022. At the same time, the blockage created in the judicial system due to non-functioning will be avoided. from October 2020, of the Evaluation Board - the one who performs the extraordinary evaluation of the performances of the judges to be appointed until the age limit is reached. Because of this, at present, about 60 magistrates, whose mandate has expired or will expire until April 1, 2022, cannot be proposed for appointment until they reach the age limit ", Minister of Justice Sergiu Litvinenco said.
Also, due to the blockage created, the files in the management of judges with expired or expiring mandates on April 1, 2022 cannot be assigned for examination to the judges in office (with small exceptions), and litigants have to wait indefinitely to examine their cases, which affects compliance with the reasonable time limit for the examination of cases.
