Normative framework related to Administrative Code to be amended in Moldova

Chisinau, 4 May /MOLDPRES/ - More normative acts will be amended, in order to be adjusted to the new provisions of Moldova’s Administrative Code, recently adopted by the parliament. In this respect, the cabinet of ministers today approved a draft on amendment of the normative framework related to the Administrative Code, the government’s communication and protocol department has reported.
„The legislation in force comprises a string of diversified regulations on aspects regarding the issuance of administrative acts with normative or individual character, the mechanisms of verification of the lawfulness of the administrative acts, of settling the applications on access to information, etc. The large number of normative acts, based on which administrative acts are issued, comprises contradictory norms which can lead to an erroneous interpretation and a defective enforcement of the law norms, which can result in the infringement of the fundamental human rights and freedoms,’’ the state secretary at the justice ministry, Eduard Serbenco, said.
Under the draft, amendments will be made to the Land Code, Fiscal Code, Customs Code, Law on access to information, Law on local public administration, Law on state secret, as well as other normative acts. The amendments are suggested, in order to bring their content and terminology in line with the provisions of the Administrative Code, in order to ensure the existence of a single legal framework in the part related to the appealing of administrative acts.
Also, the goal of this draft law is to ensure the stability of the administrative procedures, standardize the present legal framework and adjust it to the Administrative Code, which establishes the need of the observance of the preliminary procedure on the infringement of a right harmed by a public authority through the issuance of administrative acts. ‘’The amendments have the goal to get the administration closer to the citizens and improve the quality of public services provided to citizens, ensure the informing and participation of all interested sides in the taking of administrative decisions, enhance the responsibility of the public authorities, as these are normative imperatives established by the Administrative Code for all subjects involved in the administrative process,’’ Eduard Serbenco said.
