Smoking on balconies may be prohibited

Chisinau, Nov. 2 /MOLDPRES/- Smoking on the balconies of the residential buildings and in the dwellings where there are minors and pregnant women will be prohibited. The parliamentary commission for social protection, health and family approved today a draft law aimed at implementing the Protocol for the elimination of illicit trade in tobacco products.
The legislative initiative was worked out by the head of the Commission, Dan Perciun, in cooperation with the Ministry of Health, the National Agency for Public Health, the Ministry of Finance, the Customs Service and the State Tax Service.
The authors propose the inclusion in the legislation of some new notions: pipe tobacco; nicotine; tar; toxicity; new related product; import of tobacco products or related products; importer of tobacco products or related products; retail unit; confiscation; supervised delivery; illicit trade etc.
The draft also regulates the rights and obligations to import tobacco and related products, as well as prohibitions. The law is supplemented with a special article regarding the State Register of tobacco products manufacturing machinery, which will be kept by the National Agency for Public Health. At the same time, requirements are introduced regarding the notification of new tobacco products, including electronic cigarettes, but also requirements regarding related products specifying the content of the amount of nicotine, the maximum volume of cartridges and tanks of electronic cigarettes, etc.
Criminal liability for the manufacture, circulation and use of false excise stamps is also regulated. Sanctions for manufacturing for the purpose of putting into circulation false excise stamps, for marking excise goods will vary between 125,000 lei (about 6,250 euros) and 250,000 lei.
The authors propose that the new provisions be implemented within 12 months from the publication in the Official Journal of Moldova.
