Procedures of considering criminal files to be simplified in Moldova

Chisinau, 28 December /MOLDPRES/ - The parliament’s juridical commission for appointments and immunities today approved the report to the draft law which provides for the revision of the legislation, in order to simplify the procedures of considering the criminal files.
Under the draft, three simplified procedures are envisaged, meant to optimize the criminal process, such as the guilty plea, judicial agreement in public interest and judging of the cause based on the producing of evidence in the criminal prosecution phase. Thus, if the guilty plea is concluded, the accused person might benefit from a shortening of the punishment limits by one third, if the court accepts the guilty plea.
The judgement based on the evidence produced in the criminal prosecution phase can take place, only if the defendant asks for the producing of new evidence or if enough data on the guilt of the defendant come the evidence produced in the criminal prosecution phase. In this case, the limits of the punishment will be shortened by one fourth.
As for the judicial agreement of public interest, it will be applicable only for the legal entities.
The draft is to be considered in parliament’s plenum.
