Moldovan MPs vote code of urbanism and constructions in first reading

Chisinau, 26 October /MOLDPRES/ - The parliament today voted the code of urbanism and constructions in the first reading.

The code establishes the unitary legal framework which will regulate the relations in the sectors concerning the arrangement of the territory and urbanism, authorization and carrying out of construction works, materials and products for constructions, exploitation of constructions, as well as the consistent enforcement of the legal provisions in the field of the use and post-use of constructions in Moldova.    

The new code is meant to systematize the provisions concerning the stages covered for erecting a construction, beginning with the conception, designing, authorization, carrying out, exploitation, watching the bahaviour during time, as well as the state’s control in the post-use of constructions.   

The draft code also contains provisions on the way of issuance of the certificate of urbanism and the authorization for construction/dismantling. Thus, the authorization of the carrying out of constructions in settlements will be made only based on the documentation of urbanism, elaborated, subjected to expertise and approved under the law. At the same time, exceptions are envisaged too: as for the rural settlements with a population which does not exceed 3,000 residents, the issuance of the certificate of urbanism for designing will be made according to a regulation approved by the government.  About 679 settlements will benefit from the concerned simplified procedure.     

Also, the state register of companies in the field of urbanism and constructions will be created, kept by the National Inspectorate for Technical Supervision. At the same time, the new law provides for the clear-cut delimiting of the competences for the institutions with powers in the fields regulated by the present code.  

The law establishes clear provisions also for the specialists in the sector of activity of designing constructions, investors and executors of constructions. One chapter of the document is dedicated to the  intervention of the state and the local public administration as to the measures of reducing the seismic risk at the present buildings, as well as to the rehabilitation and modernization of buildings.
