Parliament amended normative framework on real estate registration

Chisinau, Nov. 30 /MOLDPRES/- Today MPs adopted the draft amending the Real Estate Cadastre Law in the second reading. The amendments aim to ensure a uniform normative framework on registration of real estate.
The document sess the adjustment of the regulations of the Real Estate Cadastre Law to the new Condominium Law. Adjustments are made to the Law on notarial procedure that refer to ensuring the integrity of documents with several tabs, presented for registration in the real estate register.
At the same time, the provisions aimed at adjusting some provisions of the Civil Code refer to the need to know the law of other states, in order to determine whether the documents issued/completed by the authorities of another country are compliant and sufficient to certify the owner's right to a real estate located in the Republic of Moldova.
Given the experience of other states, which for the attestation of the content of the foreign law require an opinion completed by a notary of that state, a lawyer or the accredited diplomatic mission on the territory of that state, a similar approach is proposed in the national legislation.
Thus, in the case of supporting documents issued by the authorities of a foreign state, in order to establish the content of the foreign law, as the case may be, the registrar, through the Ministry of Justice, may submit a request for information regarding the content of the foreign law or the applicant will present an opinion of a foreign notary, lawyer or accredited diplomatic mission on the territory of the Republic of Moldova.
Another adjustment to the provisions of the Civil Code concerns the registration of the mortgage, both in the case of the sale of the mortgaged property and its purchase by the mortgagee.
