New law to regulate trade with strategic goods in Moldova

Chisinau, 18 July /MOLDPRES/ - The trade with strategic goods will be regulated by a new law, adjusted to the EU’s legislation. The parliament approved an initiative to this end in the first reading today.  

The document provides new definitions for the strategic goods, classified in three categories: products with double use, military products, products subjected to control nationally; services of intermediating, transshipment, products of cybernetic supervision.    

The draft also sees the introduction of the procedure of preliminary registration and certification of the applicants, in order to give the right to carry out commerce with strategic goods. Also, decision-makers include new activities related to the trade with strategic goods, such as: transshipment, services of intermediating, technical assistance and carriage.      

Another provision of the draft regards the establishment of the national commission for control of the commerce with strategic goods. The composition and regulation of work of the commission will be approved by the government, which will also approve the list of strategic goods subjected to control. The commission will consider and take decisions on the release, prolongation, re-processing, suspension, cancellation and withdrawal of the authorizations and related acts for the activities of commerce with strategic goods in Moldova.      

The models of the authorizations and acts related for the commerce with strategic goods will be established by the government. The authorization will contain the information on the exporter, importer or applicant, the destination country and the one of origin of the strategic goods carried, the character of goods, validity term of the authorization and the special conditions as to the quantity and/or use of goods. The authorization’s validity term will be established by the national commission, but will not exceed two years after the date of release.    

At the same time, the new law provides for the possibility to establish restrictions on the strategic commerce. The document also envisages including the declaring of embargo to some countries, if they do not fulfill the conditions assumed by Moldova, as well as in the interest of the national security and the foreign policy or upon the decision by international organizations Moldova is member of.    

The draft law on the regime of control of the commerce with strategic goods will enter into force on 1 January 2025.
