Chisinau, 30 September /MOLDPRES/ - The Pre-Vetting Commission today came up with clarifications as to the materials of candidates’ evaluation and notes that no material of evaluation was destroyed.
According to the Commission, taking into account the recent legislative amendments, the Commission will change its Regulation on organization and work of the Pre-Vetting Commission, in order to submit the materials on evaluation to the Superior Council of Magistracy and the Superior Council of Prosecutors, respectively, before their destruction. The Commission will inform the public about this aspect.
According to the quoted source, all candidates evaluated under the Law No 26/2022 have right to ask for access to the evaluation materials before hearing or in the context of the appealing of Commission’s decision.
„Initially, the Commission included all relevant materials in the file on candidate’s evaluation. As a result of the findings of the Supreme Court of justice, in the context of the procedures of consideration of the contestations as to Commission’s decisions, the Commission changed its practice and starting from August 2023, it has been including all materials collected during the evaluation process in the file on candidate’s evaluation. In all procedures of appealing of Commission’s decisions (initial or resumed decisions on evaluation), one copy of the file on candidate’s evaluation was provided to the candidate and the Supreme Court of Justice. All evaluation materials are preserved by the Commission in electronic format. The documents on paper are scanned and digitalized and included in the file on candidate’s evaluation. A copy on paper of the evaluation materials is provided to the candidate, upon request, and in the case of the appealing of the Commission’s decision, to the Supreme Court of Justice,’’ reads the communiqué issued by the Commission.
