Moldovan Constitutional Court turns down Sosilaists' notification on lawfulness of Natalia Gavrilita's nomination for PM office

Chisinau, 2 April /MOLDPRES/ - The Constitutional Court (CCM) has declared inadmissible a notification on the control of the constitutionality of the Moldovan President’s Decree on the nomination of Natalia Gavrilita for the office of prime minister, submitted by the MPs of the Party of Socialists (PSRM), Vasile Bolea and Alexandr Suhodolski.
In the notification, the two lawmakers say that the appealed Decree run counter the Article 76 of the Constitution, as on the date of giving the vote of confidence to the government’s action programme and its entire list, the programme was not published in Moldova’s Official Journal; therefore, it was not in force. The publication of the appealed decree in the Official Journal took place post factum – a situation which hit its constitutionality.
Also, the notification’s authors believe that the appealed decree runs counter the Constitution, as both at the nomination of Natalia Gavrilita as candidate for the PM office and at the presentation of the cabinet’s action programme and entire list, the Moldovan president and the candidate did not have the goal to get the vote of confidence, but the parliament’s dissolution.
The CCM magistrates stated that, on 11 February 2021, the parliament had considered the request by the candidate for the office of prime minister, Natalia Gavrilita, and did not backed her. Thus, by turning down the request for the government’s swearing in office, the appealed decree was consumed and the consumed acts cannot be subjected to constitutionality control.
The Court stated that the notification was lacking object and cannot be accepted for consideration on the merits.
The present decision is final, cannot be subjected to any appeal, enters into force on the date of adoption and is published in the Official Journal.
