Moldovan Constitutional Court issues opinion on possibility of parliament's dissolution

Chisinau, 15 April /MOLDPRES/ - The magistrates of the Constitutional Court (CCM) today ruled that ‘’the impossibility of the government’s formation in accordance with the Constitution’s provisions is ascertained as circumstance which justifies the parliament’s dissolution.’’ Two CCM judges had separate opinions. 

CCM President Domnica Manole informed that ’’the impossibility of the government’s formation in accordance with the Constitution’s provisions is ascertained as circumstance which justifies the parliament’s dissolution.’’ This ruling is final and cannot be subjected to any appeal; it enters into force on the date of adoption and is published in the Official Journal (Monitorul Oficial).    

“Two separate opinions were formulated to the present opinion. It is about the separate opinion of judge Vladimir Turcan and the dissident opinion of judge Serghei Turcan,’’ Manole noted.   

Today morning, President Maia Sandu came to the CCM meeting, where the notification on the finding out of the circumstances justifying the parliament’s dissolution was considered. Sandu said that she had personally come to unveil and support the viewpoint and bring the legal arguments. ‘’Honoured Court, I am aware of the fact that the parliament’s dissolution can be enforced only as the last solution, when all other ways of solving the political crisis were exhausted. We presently face exactly this situation of last solution. This parliament failed to appoint a government, rejecting at least two cabinets put forward. This notification to CCM is different through its character – unlike other cases, the justice is not made for one of the sides. This justice is demanded by the citizens or, this is the mission of a state’s institutions – to follow the citizens’ interest. And if one of the institutions fails in this mission, the Constitution establishes the way for justice to be done for the citizens,’’ Maia Sandu said.    

Also at a today’s meeting of CCM, the parliament’s representative demanded the challenge of judge Nicolae Rosca. The demand was turned down.
