Moldovan MPs vote law on prevention in final reading

Chisinau, 22 April /MOLDPRES/ - The parliament adopted a draft on the amendment of the law on the state control over the entrepreneurial activity and the contravention code at a plenary meeting today. The draft, voted in the second reading, proposes a mechanism of prophylaxis/prevention against possible abuses on behalf of control bodies against the business environment.   

The draft law on prevention was put forward as legislative initiative by the head of the commission for the control of public money, lawmaker of the ACUM faction, Dignity and Truth Platform Igor Munteanu. The author said that the draft law came as response to the need to improve the business environment and protect the small business from numerous obstacles to doing private business.

Thus, the draft introduces certain norms on the control body’s obligation to guide the economic agent through elaboration of guides, informative notes, to help those checked by control bodies. Also, the draft contains a norm which allows the side hit to recover the damages caused by an inspector, which points to an asymmetrical relation between the control body and the subject of verification, meaning such a leverage of mutual responsibility.  

At the same time, the draft sees the term of remedying provided by the prescriptions issued by inspectors, which should not be shorter than 30 days and with possibility to be extended up to 90 days, depending on the case’s complexity.  

The draft introduces new norms also in the Contravention Code as regards the plan of remedying, which will be enforced exclusively in the sector liable to sanctions following control’s by state.  

According to Igor Munteanu, about 45 per cent of the business environment’s representatives say that namely during the control, exercised by the competent state institutions, one can see the informal an formal rules of extorting bribe from newly set up private companies, many of which even do not have minimal knowledge of administration and good management of the business.
