Sports litigations to be settled by Arbitration Court of Chamber of Commerce in Moldova

Chisinau, 26 May /MOLDPRES/ - The Chamber of Commerce and Industry (CCI) of Moldova has launched the procedure of arbitration of sports litigations, in order to facilitate the settlement of disputes in the sport sector. The arbitration is an alternative to the classical justice, with the help of which the litigations can be considered by an arbitration court chosen by the sides.     

The Arbitration Court at CCI will solve litigations emerging in the physical culture and sports field, especially the ones dealing with the work of sports organizations of amateurs and professionals, as well as their members.

“Any arbitration dispute directly or indirectly connected with sport can be submitted by the Commercial Arbitration Court at CCI, which is a non-governmental institution, the task of which is to promote the domestic and the international commercial arbitration, as well as the procedure of mediation as alternative mechanisms of settling commercial litigations. Given that the sports arbitration has become a practice necessary for this field, the Chamber will organize, on the next period, in cooperation with the National Olympic and Sports Committee from Moldova, webinars for the sports associations and federations, in order to inform them about the opportunities and benefits provided by the sports arbitration,’’ CCI head Sergiu Harea said.        

For a litigation to be submitted to arbitration for consideration, the concerned sides should sign an arbitration convention or such provision should be included in the Statute, contracts and other documents of the sports organizations of amateurs or professionals.  

The examination of sports litigations will be carried out according to the regulation on the procedure of arbitration of sports litigations, as well as in accordance with the legislation in the physical culture and sport sector, Olympic Charter of the International Olympic Committee, Statutes of the International and domestic Sports Associations and Federations of professionals and amateurs, as well as other international associations.   

The sports arbitration appeared for the first time in 1984 in Lausanne, Switzerland, where the Court of Arbitration for Sport, known as Supreme Court for Sports Disputes, was founded. The Court of International Commercial Arbitration under CCI of Moldova was set up in 1993 for settling commercial litigations in the relations between entrepreneurs. In 2020, the institution considered 128 files, which cover a wide range of sectors of the economy, including trade, transport, renting, services of constructions and engineering, etc.
