Moldovan top court partially admitted fiscal secrecy

Chisinau, 10 August /MOLDPRES/- The provision in the Fiscal Code on fiscal secrecy is constitutional.
In today's meeting, the Constitutional Court recognized as constitutional the provision in the Fiscal Code that refers to fiscal secrecy.
At the same time, constitutional judges have ruled that tax authorities and courts can verify, when examining cases concerning access to information, the existence of a legitimate aim to restrict access to information which constitutes a tax secret.
„The Court partially admitted the notification regarding the control of the constitutionality of article 129 (19) of the Fiscal Code, submitted by the deputy Dumitru Alaiba. Article 129 (19) of the Fiscal Code is constitutionally recognized, insofar as the tax authorities and the courts may verify, when examining cases concerning access to information, the existence of a legitimate aim to restrict access to information which constitutes a tax secret and may balance the competing principles ", said President of the Constitutional Court Domnica Manole.
