File of Ilan Shor transferred back to Chisinau Court of Appeal

Chisinau, 21 August /MOLDPRES/ - The Supreme Court of Justice (CSJ) on 20 August ruled to transfer the file on the charging of Ilan Shor back to the Chisinau Court of Appeal, after three years and four months of the file’s consideration at the Cahul Court of Appeal.
“It is worth mentioning that each reason invoked by the defence, taken individually, was object of examination of those nine earlier applications on transfer and CSJ assessed them properly, turning down the applications,’’ reads a press release by the Prosecutor General’s Office (PG).
Therefore, for the first time ever, CSJ reasoned its ruling by a ‘’collective suspicion of impartiality, related to the alleged deeds which founded the conclusion’’, in order to return the file to the initial court.
Thus, after reaching the phase of finishing the judging of the case, following the presentation of the evidence of the prosecution and the defence, hearing the witnesses and considering the materials, the Chisinau Court of Appeal is to resume the examination of the concrete case from the very beginning.
Under the criminal procedure legislation, the consideration of the application at CSJ takes place without prosecutor’s participation.
“Although the CSJ’s solution is irrevocable, the Prosecutor General’s Office disapproves of the way the supreme court interpreted the criminal procedural norms and related them to the actual circumstances of the case or we consider that the latest application on transfer was to be rejected on grounds of repetition,’’ the quoted source said.
Presently, Ilan Shor is put on the wanted list internationally, after he left Moldova in June 2019. His file was pending at the Cahul Court of Appeal starting from September 2018 and since then tens of court sessions have been postponed.
