Prosecutor nominated by Superior Council of Prosecurtors rules to open criminal file against prosecutor general

Chisinau, 5 October /MOLDPRES/ - The prosecutor, nominated by the Superior Council of Prosecutors (CSP) today for analyzing the notification by MP Lilian Carp, ruled to start criminal proceedings against Prosecutor General Alexandr Stoianoglo. Justice Minister Sergiu Litvinenco made statements to this effect today.
According to Litvinenco, under the Article 55/1 from the Law No 3/2016 on the Prosecutor’s Office, ‘’the mandate of the Prosecutor General, against whom a criminal file was opened, in the conditions of the Article 270, paragraph (7) of the criminal procedure code, is suspended de jure on the period of the criminal prosecution.’’
“Also, by operation of the law (Article 18, paragraph (4) of the Law No 3/2016 on the Prosecutor’s Office), the deputies of the Prosecutor’s General are suspended de jure too. Therefore, presently, we do not have a leadership of the prosecutor’s office,’’ Litvinenco wrote.
The justice minister noted that, although the law sees that CSP convenes at a meeting in five days after such a situation appears, ‘’I believe that it is necessary to convene an extraordinary meeting just today, in order to select and put forward an interim prosecutor to the country’s president.’’
