Moldova's legislation on work of notaries to be amended, to improve quality of services provided

Chisinau, 12 January /MOLDPRES/ - The government today approved a draft law on the amendment of the legislation on the work of notaries, the government’s communication and protocol department has reported.
Its goal is to improve the quality of the notary act, to contribute to optimizing the activity of the notaries and provide all rights of applicants for notary services, as well as to avoid the situations when the collegial bodies of the Notary Chamber, of the licencing commission and disciplinary college are non-functional.
Thus, the draft law sees the completion of the article on the notary’s area of work with the phrase: ‘’The change of the area of work between notaries is not allowed.’’ By this intervention, decision-makers will consolidate the current provision, according to which the change of the area of work between the notaries is not permitted.
Also, it is proposed that the notary takes the oath also before the head of the Notary Chamber, not only the before licensing commission and the justice minister. Also, it is suggested that the extraordinary meeting of the General Assembly of Notaries can be summoned including by the head of the Notary Chamber.
The law on the organization of notaries’ work will also completed with a stipulation which will allow the Council members to benefit, for each meeting in which they will participate, from an allowance equivalent to one third of the average salary on the economy, but not more than for three meetings per month. The allowance will be paid by the Notary Chamber. At the same time, the draft sees that the notaries bear disciplinary responsibility, if they are absent from two meetings summoned in a row, of the General Assembly of Notaries or other collegial body, at which they were elected, appointed or delegated.
The draft law will be submitted to parliament for adoption.
