Demolition of unauthorized constructions, cutting of trees to be regulated in unitary way in Moldova

Chisinau, 1 June /MOLDPRES/ - The cabinet of ministers today approved a regulation on the way of demolition of unauthorized constructions and cutting of trees and bushes, the government’s communication and protocol department has reported.

The document, worked out by the Justice Ministry, establishes the competences and conditions for the carrying out of the works of demolition and cutting, the way of assessing the expenses necessary for the carrying out of these works, as well as the criteria of recovery of the spending at the expense of the trespassers/owners of the concerned assets.     

„Through this Regulation, decision-makers have the goal to create a unitary normative framework, which is to regulate the procedure of demolition of unauthorized constructions or cutting of trees and bushes, instructed as safety measure by the law court and thus to exclude differentiated approaches from case to case or from one settlement to another. Thus, additional premises will be created to ensure equity and the observance of the rights of the sides involved in the demolition and cutting procedure,’’ Justice Minister Sergiu Litvinenco said.     

The regulation also clearly sees the stages of the process of demolition or cutting, which must be covered, in order to ensure both a transparency and correctness of the concerned processes. Thus, after the court instructs the demolition of the unauthorized construction or the cutting of trees and bushes, the competent public authority, under the Regulation’s provisions, will hand to the infringer the prescription on the voluntary compliance and fulfillment of the stipulations of the enforceable document.    

In situations when the trespasser does not comply or drags the enforcement of the document, under which the demolition/cutting was instructed, the competent authority will directly issue the instruction on the forced execution of the works on demolition of unauthorized construction or on the cutting of trees and bushes. In this case, the spending for the carrying out of the demolition or cutting works, as well as the expenses for the services of loading, carriage and depositing of assets or materials resulted following the demolition or cutting will be borne by the trespasser/owner. The sides will pay based on the calculations presented by the economic agent who provided the concerned service.
