New legislative norms to enter into force in Moldova as of 1 January 2023

Chisinau, 22 December /MOLDPRES/ - The parliament today approved, in the second reading, a draft law on the amendment of normative acts, the goal of which is to strengthen the capacities of the State Labour Inspectorate in combating the unregistered labour.
Thus, the State Labour Inspectorate will be given the power to notify the State Fiscal Service (SFS) in the case of the finding out of unregistered labout in the employer’s work or the payment of the salary or other benefits without reflecting them in the accounting records. Also, the document provides for the empowering of the Inspectorate with the right to consider contraventions, if aforementioned cases were ascertained in the employer’s work.
The draft also sees that the labour inspectors will not be able to be founders of private external services of protection and prevention or to carry out activity of instructor. Additionally, inspectors will be obliged to declare the conflict of interests, if close people, defined through the law on the declaring of the personal wealth and interests, have the capacity of founder within the external services of protection and prevention.
Also, the legislation was completed with an additional ground for the carrying out of unforeseen controls. More exactly, the unforeseen controls will be able to be carried out also in case of holding information or indexes, backed by evidence, on the use of unregistered labour or the payment of the salary or other benefits without their reflection in the accounting records at the employer.
