Recovery of expenses for providing state legal assistance to be carried out through new mechanism in Moldova

Chisinau, 28 December /MOLDPRES/ - The parliament’s juridical commission for appointments and immunities today approved the report on a draft of amendment of normative acts, among which the Enforcement Code and the law on the state guaranteed legal assistance.   

The document sees that the money owed by the beneficiary of the state guaranteed legal assistance is falling due following the expiration of the term of 30 days after the date indicated in the notification on the reception of the decision on recovery, confirmation of the decision’s submission or informing about the decision through advertising. If the debt was not paid voluntarily, it will be paid in line with the procedure of enforcement of the receivables, based on public law stipulations, approved by the government.      

Additionally, to ensure guarantees on the informing about the decision on recovery, if its notification was not possible by mail with recommended letter and with notification on reception or through other means, which would ensure its reception, the establishment of additional procedures of communicating the decision is suggested, similar to those of notifying acts to the State Fiscal Service.
