Moldova wins case in file on payment for electric energy

Chisinau, 11 January /MOLDPRES/ - The Paris-based Court of Appeal pronounced its final decision on the cancellation of the sentence of the Paris Ad hoc Arbitration Court from 25 October 2013 on the cause SPC Stileks (successor in rights of LLC Komstroy and LLC Energoalliance (Ucraina)) against Moldova. Justice Minister Sergiu Litvinenco unveiled information to this effect.
According to Litvinenco, ‘’The Court established, in the absence of an investment protected by the Energy Charter Treaty from 1994, the lack of competence of the arbitration court. ‘’At the same time, besides obliging SPC Stileks to pay the court charges, the court of appeal also instructed the collection in favour of Moldova of a sum of 250,000 euros as other expenses,’’ the justice minister said.
Under the sentence of the Paris-based Ad Hoc Arbitration Court from 25 October 2013, judges ruled the collection of a sum of 592,881,395 lei (about 296.4 million euros) and 540,000 dollars from Moldova for the benefit LLC Energoalliance (presently SPC Stileks). The object of the cause was the alleged non-payment by the state enterprise Moldtranselectro of the electric energy supplied during 1999-2000.
