Moldova's Constitutional Court, Supreme Court of Justice to be able to ask evaluation notice of European Court of Human Rights

Chisinau, 14 April /MOLDPRES/ - The Constitutional Court and the Supreme Court of Justice will be able to ask the European Court of Human Rights (ECHR) to issue an evaluation notice of principle on the interpretation or enforcement of the rights and freedoms defined in the convention on the protection of human rights and fundamental freedoms. The parliament voted a draft law which envisages this in the second reading today.
Under the document, this will be possible only in case of litigations in the process of settlement before jurisdiction bodies and the request will be grounded through the presentation of the aspects relevant of the legal and de facto context of the concerned cause.
The ECHR’s evaluation notices are not compulsory, but will have legal importance. At the same time, the notification of the European Court of Human Rights for the issuance of an evaluation notice will not hinder the subsequent formulation of an individual application to ECHR in connection with this cause.
