Law on Prosecutor's Office to be amended

Chisinau, April 26 /MOLDPRES/- Cabinet approved today the draft amending the Law on the Prosecutor's Office, aimed at increasing the independence of the system and strengthening the capacities of the Superior Council of Prosecutors (CSP), the government's communication and protocol department has reported.
It was decided to transfer the Prosecutors' Inspection, which is now subordinate to the General Prosecutor's Office, to the CSP composition. With the proposed amendment, the Inspectorate has functional autonomy, which is necessary for the independent examination of notes on prosecutors' disciplinary misconduct. The law will also be supplemented with a broader list of disciplinary violations, and the statute of limitations will be extended to allow complex examination of committed violations. The number of inspectors was also increased from 6 to 9.
It was also approved the creation within the CSP of a unique college responsible for evaluating the ethical and financial integrity of prosecutors who will never be subject to the first assessment. Thus, through these instruments, it is proposed to assess the wealth and integrity of all prosecutors in office, as was done in the case of judges.
Among the changes related to the activity of the CSP as the constitutional guarantor of the independence and integrity of prosecutors are: the review of the composition of the CSP and its adjustment to the recommendations of the Group of States against Corruption (GRECO), formulated under the fourth evaluation round of the Republic of Moldova; reducing the mandate of the CSP president from 4 to 2 years, without the possibility of exercising two mandates with the establishment of the principle of rotation of the position of president.
The project, which was set up to implement the Strategy on ensuring the integrity of the justice sector, also includes transitional provisions regarding the efficient migration of the Inspection from PG to CSP, as well as clarifications regarding the entry into force of the law.
