Mechanism on modern legal expertise to be implemented in Moldova

Chisinau, 10 June /MOLDPRES/ - The cabinet today approved a draft law on improving the institutional and normative framework of judicial expertise system and judicial expert status. Thus, a mechanism of modern, quick and independent judicial expertise will be implemented, the government's communication and media relations department has reported.
According to the authors of the draft, a well-formed infrastructure is needed within the legal expertise system, in line with legal quality standards, as well as highly qualified judicial experts, so that evidence be properly presented at law suits. Thus, providing a judicial expertise infrastructure accessible to everyone will ensure an equitable investigation and consolidation of evidence.
The document includes ample regulations on judicial expertise, admission to the profession of judicial expert, his/her status, continuous formation and assessment of performances of judicial expert. At the same time, the draft law sees establishment of a new mechanism of sanctioning for actions which represent disciplinary infringements as to the work of the judicial expertise, as well as detailed regulation of the suspension and ceasing the activity of the judicial expert. Presently, suspension of the activity of judicial experts, who are operating in a public judicial expertise institution, is provided for only by the legal framework on labor legislation.
The new law was worked out according to studies on national judicial expertise system, revealing more deficiencies and drawbacks, such as: absence of an independent central institution that would assume the role of leadership, at national level, for the judicial expertise system, as well as lack of quality standards, necessary equipment, instruments and appropriate laboratories.
The above-mentioned draft law was meant to carry out an action stipulated in the action plan for implementing the strategy on justice reform for 2011-2016.
