Moldovan government approves draft on Labour Code amendment

Chisinau, 10 June /MOLDPRES/ - The cabinet today approved a draft law on amendment and completion of the Labour Code at a today meeting. Proposals by the Labour, Social Protection and Family Ministry, National Employers’ Confederation and National Trade Union Confederation were at the basis of working out this bill. Prime Minister Chiril Gaburici praised the involvement of Employers’ and Trade Union Confederations in elaborating the draft on amendment of the Labour Code, the government’s communication and media relations department has reported. 

The draft law stipulates modification and/or completion of about 40 articles of the Labour Code and is meant to improve the labour legislation in force and adjust it to the modern requirements of the market economy.

Among the most relevant amendments and completions, contained in the bill, there are:

- termination of individual employment contract only upon the consent of parties in written form, which is not possible at present;
- simplification of the dismissal procedure for organisation’s head, deputy heads and chief accountant;
- improving the norm on the absence from work without valid excuse, as well as the one regarding the prohibition of dismissal without the consent of trade unions;
- specification of dismissal procedure, if the is liquidated or number of staff or positions is reduced;
- detailing of dismissal procedure as to transfer to another unit or re-establishment of wage earner in post;
- regulating the way of recovering the days declared by government, as days-off, etc.

The document is to be forwarded to parliament for consideration.
