Chisinau, 12 June /MOLDPRES/- The giving up by the prime Minister of his office leads to the government's resignation in full composition, according to the law on government. The same law sees that the application on resignation by the prime minister and government members is submitted to the parliament, which is to give its ruling on it.
The legislation stipulates that the acting government fulfills the duties of managing public affairs until the government members take the oath.
Thus, the main duties of the acting government are enforcement of laws, control over the activity of central specialised institutions, carrying out programmes on economic and social development of the country, etc.
To fulfill the concerned duties, the acting government has the right to okay decisions and instructions and approve legislative initiatives.
A member of the Superior Council of Magistracy, Teodor Cirnat, said that "the acting prime minister is to exercise the post duties until a new government is sworn in office; yet, another candidate may be appointed too."
Cirnat said that the law did not see a certain term for delegating a new prime minister; but after the president nominates a new candidature, the parliament has at its disposal 45 days to vote.
Chiril Gaburici was voted as prime minister on 18 February 2015 with 60 pros of the Liberal Democratic Party, Democratic Party and Party of Communists. Gaburici today tendered resignation.
