Moldovan state, municipal enterprises to have status in new version

Chisinau, 18 October /MOLDPRES/ - The central public administration and municipal authorities will have to ensure, in a one-month period, the approval of the statuses of the enterprises under their administration in a new version, according to a decision approved at a cabinet meeting today. On the same period, new individual labour contracts are to be signed with the managers of the state and municipal enterprises.
The cabinet of ministers approved a package of statutory documents on the state and municipal enterprises, including the model status of these entities, model regulation on the organization and carrying out the contest for holding the vacant position of manager of the state and municipal enterprise. Another three documents refer to the model of the individual labour contract of the manager of the state/municipal enterprise, model regulation of the administrative board and of the auditing commission of the state enterprise.
Under the status, the minimum limit of the state enterprise’s registered share capital is of 5,000 lei and if its net assets are under the limit of 5,000 lei, the enterprise is dissolved. The public assets managed by the state enterprise do not belong to this enterprise as a right of ownership. These assets cannot be followed for the debts of the economic agent, cannot be sold or subjected to enforcement, not even in the case of insolvency, cannot represent subject of pledge and no real guarantees can be made on them.
The members of the administrative board are nominated by the founder for a two-year period, being elected by contest. The Economics and Infrastructure Ministry, which is the author of the drafts, proposes to complete the contract with the manager with an annex, which contains the performance indexes necessary for assessing the results of manager’s work.
According to the cabinet decision, the acts in the new version are to be enforced in a one-month term after the government decision’s publication at the latest.
