Moldovan judges guilty of conviction at European Court of Human Rights to pay damages inflicted

Chisinau, 26 November /MOLDPRES/ - The parliament has established the state’s right to sue for compensation against the judges whose actions or inactions contributed to Moldova’s conviction by the European Court of Human Rights (ECHR).
Thus, judges will bear material responsibility proportionally to the degree of guilt established in the state seeking legal remedy against judges, through which the state demands the compensation of the damages paid by the state. The judges are to be called to criminal or disciplinary liability only for the cases in which, under final sentence, their guilt was established or the serious intention or negligence was ascertained within a disciplinary procedure.
Prosecutors are also to be sanctioned, according to the legislative initiative. The period of prescription for calling a prosecutor to account for disciplinary infringements will be of one year starting the date when the national court’s ruling becomes irrevocable, but not later than five years after the infringement is committed.
