Moldovan cabinet approves draft of new Land Code

Chisinau, 23 December /MOLDPRES/ - The cabinet of ministers on 22 December approved the draft of the new Land Code. The document regulates a new classification of lands, way of their use, property on lands, classification of lands with agricultural purpose, lands of the forest fund, obligations of the landowners and interdictions of getting the title, etc. The goal was to create a new legislative framework for regulating the land relations, adapted to the current realities.
The new draft of the Land Code is made up of 12 chapters and 78 articles and has the goal to meet the general interest of the society and solve the problems formulated by farmers. ‘’A regulation which we highlight in the new Code is the fact that the landowners will be obliged to undertake measures of preventing and diminishing the impact of soil’s degradation, according to measures of soil’s protection within the agricultural practices. At the same time, decision-makers included the interdiction to acquire the title on lands with agricultural purpose by foreign private people and legal entities or stateless persons, according to the absolute nullity sanction of the legal act on acquiring,’’ Agriculture, Regional Development and Environment Minister Ion Perju said.
At the same time, the lands abandoned by the owner will be transmitted on lease, with this right belonging to local public authorities, being exercised only at the existence of pre-conditions and observance of a procedure of summoning the owner.
„Another regulation contained in the document of the Land Code deals with the consolidation of farmlands for the creation of farms which would give possibility to use advanced technologies. Thus, it was established that the plots of land which belong to different owners could be repositioned within the borders of the same consolidated land. I would like to say that, when working out the normative framework, decision-makers identified also legal solutions as to the technological roads and other lands meant for agricultural activities, which are no longer involved in the technological processes from agriculture, as a result of the clearing of multiannual plantations or consolidation of farmlands,’’ the competent minister added.
