Moldovan top court suspends action of article of law on medicines

Chisinau, 5 January /MOLDPRES/- The Constitutional Court suspended today the provisions on completing and amending Article 61 National price catalog of Law No240 of 16 December 2020, the Law on Medicines.
The constitutional judges suspended today a part of the provisions of Law No240 of 16 December 2020, the decision was issued following a complaint submitted by a group of MPs.
The Constitutional Court suspended the action of Article I (3) of Law No240 of 16 December 2020 until the resolution of the case. Constitutional judges found that if the action is not suspended, the contested provisions could be implemented and could have effects, for example, on setting and changing the price of medicines.
At the same time, the Constitutional Court noted that the suspension solution is necessary to avoid the negative consequences in fundamental human rights and freedoms, in particular for the right to health care, guaranteed by the Constitution.
The judges decision is final, cannot be subject to any appeal, shall enter into force upon adoption and shall be published in the Official Journal.
