Moldovan president asks checking constitutionality of laws limiting powers of head of state, outgoing government

Chisinau, 11 January /MOLDPRES/ - President Maia Sandu today submitted a notification to the Constitutional Court (CCM), thereby demanding ‘’the verification of the constitutionality of more laws which limit the country’s president and the outgoing government in exercising their powers.’’
„My request deals with the right of the president and the outgoing government with the acting prime minister to make staff reshufflings in exceptional cases and the right of the outgoing government to sign international treaties, in certain conditions. I also asked the declaring as unconstitutional of more provisions from the Law on Government, which deal, in particular, with the nomination of the acting ministers exclusively among the members of the outgoing government, in conditions when this is not provided for in the Constitution and, at the same time, this might create even greater dysfunctions in institutions’ management,’’ the notification by the head of state reads.
According to Maia Sandu, the giving of its opinion by the Constitutional Court on these aspects ‘’will clear up the present situation, in which the country found itself following the irresponsible actions by some lawmakers, the former president and former PM, in attempt to destabilize the situation in the country.’’ ‘’The government, even the outgoing one, must be able to ensure the country’s administration till the appointment of another government. This means possibility to carry out reshufflings, dismiss and appoint officials and civil servants in certain conditions, access funds in certain constitutional limits,’’ the notification reads.
„The unprecedented situation, deliberately created by the former governance, in order to make the state weaker and more vulnerable, in the full swing of pandemic and economic crisis, can be settled through the giving of opinion by the Constitutional Court and clarification of gaps and contradictions identified in the notification submitted today,’’ reads the notification to CCM, sent by President Maia Sandu.
