Constitutional Court, Court of Justice to be able to request advisory note of ECHR

Chisinau, March 16. /MOLDPRES/- The Constitutional Court and the Supreme Court of Justice will be able to request the European Court of Human Rights (ECHR) to issue an advisory note on matters of principle regarding the interpretation or application of the rights and freedoms defined in the Convention for the protection of human rights and fundamental freedoms. The bill was voted today in the first reading by 69 MPs.
According to the document, this will only be possible in the case of disputes that are being resolved before the jurisdictional bodies, and the request will be motivated by presenting the relevant aspects of the legal and factual context of the respective case.
According to the legislation, the advisory notes of the ECHR are not binding, but they will have legal importance.
