Moldovan top court rules on interpreting Constitution as to premier's resignation

Chisinau, 17 June /MOLDPRES/ - President Nicolae Timofti has a three-month term, in order to designate a new prime minister of Moldova. This is the decision by the Constitutional Court, which today ruled on Timofti’s request to interpret the Constitution as to the resignation of prime minister.
Under the Court’s decision, the head of state is constitutionally obliged to appoint an interim prime minister till a new government is formed, if it is definitively impossible for the resigned prime minister to exercise his/her office.
„The definitive impossibility to exercise the office of prime minister means the general situation of any circumstance, which impedes continuation of exercising the respective post, other than death, including the resigned prime minister’s express refusal to continue exercising his/her duties till a new government is created,” the decision says.
The Constitutional Court also specified that, starting the moment when the resignation of prime minister was communicated, the government was exercising only the duties of managing public affairs, till a new cabinet of ministers is sworn in office.
The Court’s decision is final, cannot be subject to any appeal, enters into force on the date of adoption and is published in the Moldovan Official Journal (Monitorul Oficial).
