Moldovan government approves draft code of town-planning, constructions

Chisinau, 20 April /MOLDPRES/ - The cabinet of ministers today approved a draft of the Code of Town-planning and Constructions. The document sets a unitary legal framework for town-planning, territorial planning, authorization and carrying out of works of designing and constructions, ensuring the quality of constructions, materials and products for constructions, exercising the state control over the observance of discipline in town-planning and the regime of constructions’ authorization.
“There is no a systemic approach in the development of territories. Plans on their arrangement are lacking, and hence, the territories’ development is chaotic, a great deal of the settlements are developing without having a general urbanism plan,” the Regional Development and Constructions Ministry has said.
The lack of general urbanism plans, as well as of regulations on exploitation of constructions triggers an increase in the number of unauthorized constructions. Presently, “the reception of constructions is limited only to ascertaining their completion,” while the use is not regulated. Also, there is no a system of normative documents in constructions, correlated to the EU requirements, which creates great difficulties in the designing and carrying out of constructions.
Besides the correlation of the normative acts regulating this sector, the Code of Town-planning and Constructions will systematize and correlate the instructions from the field into a unitary structure, will remove dysfunctions emerged so far. The Code will clear up aspects on Moldovan legislation’s approximation with the principles and regulations of the European Union.
The draft law approved by the government sees clear-cut rules which regulate all phases of a construction, as well as clarifies the powers for institutions in charge of this sector, including the state control in the field. The draft, discussed at 11 roundtables, is to be submitted to parliament for consideration.
