Moldovan cabinet approves draft on amending legislation

Chisinau, 4 May /MOLDPRES/- The cabinet approved a draft on amending the legislation saying that competencies of a government with expired mandate will be limited. The resigned government will not need to approve and present draft laws or to give approvals, to appoint or to revoke from office public dignitaries or to conclude treaties.

According to the amendments proposed by the Justice Ministry, the legislation is radically amended. The amendments stipulate what the outgoing government is not allowed to do. It has no right to approve and present to the parliament draft laws and draft documents of policies, to approve legislative initiatives, to appoint or to dismiss public dignitaries.  

Thus, the government with expired mandate should have only public affairs management functions without promoting new policies. In the draft’s information note, it was referred to other states with similar provisions, among which Romania, Serbia, Germany, the Netherlands and Spain.

Under the amendments operated in 2013 in the law on government, acting premier has the same duties, except for adopting the decision on resignation of government or premier, as well as forming and proposing the government composition. He can elaborate draft state budget, can sign international agreements and make staff reshuffling.

The Constitutional Court recognized as unconstitutional the provisions related to the right to approve the legislative initiatives and elaboration and submission of the draft law on state budget to the parliament for approval.  The court notes that the outgoing government can only elaborate a draft budget, but its presentation is to be carried out by a plenipotentiary cabinet.

The draft on amending the legislation is to be presented to the parliament for adoption.
