Moldovan government approves draft law on specialised prosecutions

Chisinau, 15 June /MOLDPRES/- The cabinet today approved a draft law on organizing and functioning specialized prosecutions. The document sees setting up of Anti-Corruption Prosecution, Prosecution for Combating Organised Crime and Special Causes, and is meant to create an independent, efficient and transparent justice system, the government’s communication and media relations department has reported.
Under the draft, the specialized prosecutions will have separate budget, a distinct organization chart with special powers. Their headquarters will be located in Chisinau, with territorial offices or representations in territory, which will be approved by the Prosecutor’s General Office, following a proposal by chief prosecutor of the specialized prosecution, with the consent of high council of prosecutors.
Under the organization chart, maximum 50 prosecutors, 40 consultants, 31 criminal investigation officers, 10 specialists and 7 employees in the technical and administrative staff are scheduled. Prosecutors within the specialized prosecution are independent in procedural way, being headed by chief prosecutor, helped by a deputy or, if needed, deputies. Criminal investigation officers and specialists will be selected by a chief prosecutor of the specialized prosecution and detached from other institutions for a five-year period, having the possibility to extend the term for a similar period, according to an order by the Prosecutor General.
Setting up of specialized prosecutions is carried out in accordance with the strategy on justice reform for 2011-2016 and the concept on prosecution reform. The action is fitted into measures seen in the EU-Moldova Association Agreement.
The document is to be considered by the parliament.
