Moldovan Competition Council gains success in case of Customs Service

Chisinau, 2 September /MOLDPRES/ – Chisinau Court sector Centru rejected as unfounded the request for summons of Moldovan Customs Service against the Competition Council (CC) on canceling CC Plenum decision, which established violation of the Law on Competition Protection.
A Competition Council press release states that CC Plenum found a violation of Protection of Competition Law from Customs Service by creating unjustified situations of enterprises providing service inside the terminal. The Customs Service has organized procedures for the selection of private partners expressly stipulated by legislation that limited competition and participation in the selection of potential businesses.
At the same time, the supervisory regime is obliged to carry out customs procedures for selecting necessary in strict compliance with competition rules in force.
Law on Protection of Competition provides that public authorities may not grant unfounded or otherwise tax incentives to enterprises, to create a privileged position compared to other undertakings operating on the same commodity market.
