INSTRUCTION No 14 of Moldova's Commission for Emergency Situations from 6 April 2020

Chisinau, 6 April /MOLDPRES/ - In accordance with the Article 22 from the Law No 212/2004 on the regime of state of emergency, of siege and war, Article 2 of the Parliament Decision No 55/2020 on the declaring of the state of emergency, points 6, 7, 8 and 9 from the Regulation of the Moldova’s Commission for Emergency Situations, approved under the Government Decision No 1340/2001, Moldova’s Commission for Emergency Situations,
INSTRUCTS:
1. The days on the period 7 – 17 April 2020 are declared days off for all public sector units and the self-managed public institutions/authorities, except for:
1.1. the medical, sanitary, public health institutions and auxiliary services, rescue services, emergency and social assistance services;
1.2. the administrative authorities from the national defence sector, public order and national security;
1.3. the education institutions of all levels (early education, primary, secondary, vocational, higher education institutions, extra-school and special education institutions), which will ensure the distance education process.
2. The recovery of these days will be carried out in the way established by the government, after the state of emergency is lift.
3. The days off are not regarded for the employees which on the period 7-17 April 2020:
3.1. ask for the providing/are on annual leave (Article 112 of the Labour Code), including the unused leave (Article 119, paragraph (3) of the Labour Code), with the payment of the leave allowance (Article 117 of the Labour Code) and unpaid leave (Article 120 of the Labour Code);
3.2. are in standing regime, according to the order issued by the employer.
4. The days from 7 till 17 April 2020 are included in the table of record of the working time and of calculating the salary for April as working days.
5. The heads of the public sector units and the heads of the self-managed institutions/authorities on the period 7-17 April will attract the strictly necessary staff to ensure the functionality of the processes, including the distance ones.
6. By derogation of the provisions of the Article 120, paragraph (1) from the Law No 171/2012 on the capital market, the term of publication of the annual 2019 report of issuances of movables is extended till 29 May 2020.
7. The general assemblies of shareholders in 2020 will take place in two months after the lifting of the emergency state at the latest, starting from 29 May 2020.
8. By derogation of the Article 37, paragraph (2) of the Law No 139/2007 of the savings and loan associations, the term of holding ordinary general assemblies in 2020 is extended by two months after the lifting of the state of emergency at the latest.
9. During the state of emergency, the passing of the terms provided for in the Article 29, paragraphs (6-1) and paragraph (12) from the Law No 407/2006 on insurances is suspended.
10. During the state of emergency, the terms of carrying out, in line with the provisions of the chapter 111 of the Fiscal Code No 1163/1997, of preliminary fiscal verifications and/or fiscal controls, with the enforcement of indirect ways of assessing the taxable income of private people, including for the ones initiated till the establishment of the emergency state, are suspended.
11. The providing of hairdo services and other beauty activities, code CAEM S96.02, is suspended on the state of emergency period.
12. The point 15 of the Instruction No 6 of Moldova’s Commission for Emergency Situations from 26 March 2020 is abrogated.
13. The Instruction No 13 from 3 April 2020 of Moldova’s Commission for Emergency Situations is amended as follows:
13.1. the words ‘’and to patients’’ are excluded at the point 3;
13.2. at the point 10, first paragraph, the text ‘’35.5 million lei’’ is replaced by the text ‘’35.7 million lei’’ and at the sub-point 3), the text ‘’the sources of the funds of the prophylaxis measures – 5.5 million lei’’ is replaced by the text ‘’the sources of the funds of the prophylaxis measures – 5.7 million lei.”
14. One-off allowance worth 16,000 lei is established for the employees of the public sector authorities/institutions and the public medical and sanitary institutions who were infected with COVID-19 while fulfilling their job duties.
15. The one-off allowances set at the point 14 will be allocated from the government’s intervention fund.
16. The income tax, the compulsory state social insurances contributions, individual compulsory state social insurances contributions, mandatory health insurances premiums are not applied on the one-off allowances, established according to the point 14.
17. The National Health Insurances Company will provide the full financing of the costs for the needed nourishment for the patients present at the Medical and Sanitary Public Institution COVID-19 Centre (state identification number: 1020600013951), at the expense of the mandatory health insurances accounts.
18. The work of the Medical and Sanitary Public Institution Stefan Voda District Hospital (state identification number: 1003608150228) is suspended for the period 7-20 April 2020, given the establishment of the quarantine regime for the Stefan Voda town and based on demarches by local public administration authorities.
19. The non-observance of the provisions/measures established by Moldova’s Commission for Emergency Situations, represents danger for the public health and will serve as reason for calling the guilty people to contravention/criminal account.
20. The present Instruction enters into force starting the moment of its issuance and is published on the government’s official webpage.
