INSTRUCTION No 21 of Moldova's Commission for Emergency Situations from 24 April 2020

Chisinau, 24 April /MOLDPRES/ - In accordance with the Article 22 from the Law No 212/2004 on the regime of state of emergency, of siege and war, Article 2 of the Parliament Decision No 55/2020 on the declaring of the state of emergency, points 6, 7, 8 and 9 from the Regulation of the Moldova’s Commission for Emergency Situations, approved under the Government Decision No 1340/2001, Moldova’s Commission for Emergency Situations (CSE),  

INSTRUCTS:

1. The days of 27-30 April 2020 are declared days off for all public sector units and the public institutions/authorities at self-management, except for:  

1.1. The medical and sanitary, public health institutions and auxiliary services for the public health institutions, rescue, emergency and social assistance services;

1.2. administrative authorities in the national defence, public order and national security sectors;  

1.3. the education institutions of all levels (early, primary, secondary, vocational, higher education, extra-school and special education), which will ensure the carrying out of the distance education process;

1.4. The Public Services Agency public institution, National Social Insurances House, National Employment Agency;

1.5. National Bank of Moldova.

2. The recovery of these days will be made in the way established by the government, after the emergency state is lift.

3. These days are not regarded days off for the employees who on the period 27-30 April 2020:

3.1. ask for the providing of/are on annual leave (Article 112 of the Labour Code), including the unused leave (Article 119, paragraph (3) of the Labour Code), with the payment of the leave allowance (Article 117 of the Labour Code) and unpaid leave (Article 120 of the Labour Code);  

3.2. are in regime of standing, according to the order issued by the employer.

4. The days of the period 27-30 April 2020 are included in the table of record of the working time and of calculation of the salary for April as days of presence at work.

5. The heads of the public sector units and the heads of the self-managed institutions/authorities on the period of 27 – 30 April will attract the strictly necessary staff to ensure the functionality of the processes, including the distance ones.

6. Starting from 27 April 2020, people are allowed to go to parks, in groups not larger than 3 persons, by observing the social distance.   

7. Resumption, starting from 27 April 2020, with the compulsory observance of the norms for reducing the spread of the COVID-19 infection, of the retail trade activities for all types of goods through specialized commercial units, excepting those placed in commercial centres and markets (including automobile ones)  

8. The following goods are exempted from customs taxes, taxes for customs procedures and the value added tax:

8.1. goods provided as donation for the needs of the public medical and sanitary institutions from Moldova, based on the agreement signed between the governments of Moldova and Turkey, signed in Ankara (Turkey) on 17 April 2020;  

8.2. medical masks and protection equipment offered as donation for the Public Medical and Sanitary Institution National Centre for Pre-hospital Emergency Medical Assistance and the Chisinau city hall by the Foreign Capital Enterprise HUAWEI TECHNOLOGIES Ltd.  

8.3. medical masks provided as donation to the National Public Health Agency, imported by the MALL ONLINE Ltd economic operator.

The National Commission for Emergency Situations also took other important decisions.

The non-observance of the provisions/measures established by Moldova’s Commission for Emergency Situations, represents danger for the public health and will serve as reason for calling the guilty people to contravention/criminal account.  

The present Instruction enters into force starting the moment of its issuance and is published on the government’s official webpage.
