Chisinau, 9 July /MOLDPRES/ - Any act pronounced by the Constitutional Court (CCM) is final and cannot be subjected to any form of appeal.
The Constitutional Court today ruled that any CCM’s act was final and cannot be subjected to any form of appeal. CCM President Domnica Manole said that the ground for the issuance of this ruling was the fact that ‘’the constitutional justice is placed outside the judicial powers. ’’
„The system of constitutionality control is outside the judicial powers – the delimiting of the powers is simple, the constitutional causes represent the monopoly of the Constitutional Court, the law courts have no competence to judge these causes,’’ Domnica Manole said.
At the same time, the Constitutional Court set forth its opinion on the appealing in common law court of the dismissal of constitutional judge Vladimir Turcan from the office of CCM president and ruled that the acts on the election and dismissal from office of the top court’s president were final. Explaining this decision, Domnica Manole said that ‘’the election of the Constitutional Court’s president is within the competences of CCM and no other court can replace the plenum of the constitutional judges.’’
