Moldovan president obliged to nominate candidate put forward by parliamentary majority for prime minister position

Chisinau, 6 August/MOLDPRES/- The Constitutional Court announced that the discretion of the President of the Republic of Moldova to appoint Prime Minister is limited.

The Constitutional Court / CC / ruled out today the decision for the interpretation of Articles 89, 91 and 98 (1) of the Constitution. Thus, the CC decided that "if an absolute, formalized parliamentary majority is established, the President shall appoint candidate submitted by the majority for the position of Prime Minister."

Also, if an absolute, formalized parliamentary majority is not set up, the President is obliged, after consultations with the parliamentary factions, to nominate a candidate for prime minister position, even if the parliamentary factions do not agree with the proposal.

At the same time, "if the president refuses to nominate the candidate for prime minister submitted by the absolute, formalized parliamentary majority, this situation must be resolved under p. 89 of the Constitution which provides for suspension and dismissal of the President of Moldova."

The notification on the interpretation of Articles 89, 91 and 98 (1) of Constitution was submitted on 16 June 2020 by MP Igor Munteanu.
