Biobanks' activity to be regulated by law

Chisinau, April 12 /MOLDPRES/- The parliamentary social protection, health and family committee approved today a draft law on human biobank and will submit it to Parliament for approval. The draft was set up by a group of MPs of the Action and Solidarity Party parliamentary faction.

According to deputy head of the social protection, health and family commission, Adrian Belîi, who is one of the authors of the legislative initiative, the draft offers for the first time for our country a clear regulation of the activity of biobanks and those with the purpose of scientific research.

Thus, for the first time, the notion of a biobank will be defined, which represents organized collections of data established and maintained by the administrator of the biobank, consisting of human biological samples, DNA descriptions, descriptions of health status, genealogies, data genetics and data that allow the identification of donors of biological samples. A biobank has the right to organize research activity in the field of health, personalized medicine, ensures the voluntary nature of the donation, the confidentiality of the donors' identity and the protection of individuals from the arbitrary use of genetic data and discrimination based on the interpretation of their DNA structure and the risks that derive from these.

At the same time, the rights and obligations of donors of human biological samples, the chief administrator and authorized users of the biobank, genetic researchers with reference to human biological samples, as well as the conditions for establishing and maintaining the biobank are explained. The necessary conditions regarding the consent to become a donor of human biological samples are stipulated, but also the right of ownership over the human biological samples and the stored data. The conditions for data protection are also stipulated.

By adopting the draft law on the human biobank, national legislation will be adjusted to that of the European Union.
