Moldovan top court rules on former PM's lift of immunity

Chisinau, 21 October /MOLDPRES/- The Constitutional Court (CC) today examined a notice of the Liberal Democratic Party (PLDM) on the lawfulness of the parliament’s decision to strip Liberal Democrat MP Vlad Filat of immunity. The CC ruled that the decision is not subject to suspension.
According to the top court, under the Article 70, paragraph 3, of the Moldovan Constitution, the MP cannot be detained, arrested and searched, excepting cases of flagrant offense or prosecution without the consent of the Parliament, after his/her hearing.
“The act of “consent”, in its constitutional sense, is a consumed act itself, and thus, cannot be suspended,” the court’s ruling says.
A group of Liberal Democrat MPs filed a notice to the Constitutional Court on 19 October, to contest the constitutionality of the parliament’s decision to deprive Vlad Filat of immunity.
