Methodology of calculating maximum tariffs for access to public properties enters in force in Moldova

Chisinau, 9 January /MOLDPRES/ – The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces that there entered into force the methodology of maximum fees calculation for access right to public property and/or shared use of physical infrastructure.
The ANRCETI's press service states that the document sets out how to determine the maximum fees for access right to properties and/or shared use of physical infrastructure. Also, it determines the structure and composition of these charges, specifying inclusion of direct costs in the price and costs not included in the price. The rates are calculated as a lump sum, payable by the provider of electronic communications networks after conclusion of access to public or private property with the owner of the property management.
The rates may change not oftener than once within 12 successive months, and making changes will be considered by the same principles and rules laid down by that methodology. If the supplier does not agree with the increased tariffs proposed and argued by the owner of the property, that contract parts can not agree on the management and negotiating on terms and conditions which are mutually acceptable to them, either part may appeal to ANRCETI for dispute settlement.
The ANRCETI’s Board of Directors considers that the methodology will help to develop the public electronic communications networks by optimizing costs, boosting investment in networks and communications infrastructure and to promote competition on the electronic communications market.
According to the legislation, central public authorities, local or other public institutions and any other entity which exercises management over public buildings of state or administrative-territorial units and owners of property management, determine tariffs and charges for the access right of providers of electronic communications on the respective properties. Similarly, they determine charges of shared physical infrastructure based upon a calculation methodology developed by ANRCETI and approved by the government.
