Moldovan top court declares limiting reconciliation in criminal cases constitutional

Chisinau, 21 September /MOLDPRES/ - The Constitutional Court (CCM) today recognized as constitutional an article of the Criminal Code, which provides for possibility of reconciliation of persons involved in the criminal action, on condition that they did not have another reconciliation in the last five years.  

Earlier, judge Ghenadie Eremciuc of the Balti-based court demanded that CCM decides whether the new conditions for reconciliation of the sides involved in criminal cases are valid also for those who committed deeds punished by the Criminal Code, but had reconciled before these conditions appeared in the Code. 

The Court acknowledged that the contested provisions do not apply retroactively. In conclusion, the magistrates pronounced that, by establishing a term of five years, within which the criminal reconciliation cannot be made if a there was earlier a reconciliation for similar offences, committed deliberately, the provisions of the Article 22 of the Constitution on the non-retroactivity of the law are not breached.
