Civil status body to be able to dissolve marriage in Moldova

Chisinau, 15 February /MOLDPRES/ – The marriage can be dissolved by civil status body. A draft law on it was adopted today in final reading by Parliament.
According to the amendments made to the legislation, marriage can be dissolved on basis of a joint agreement of spouses, in cases where there are no disputes concerning common property sharing, maintenance, education and residence of minor children or with regard to maintenance of one of the spouses.
Similarly, if spouses have minor children and have not reached an agreement on their domicile, education or their maintainance, or in absence of a divorce agreement of one of the spouses, marriage will be disposed by court.
The new amendments also provide for completion of the code of civil procedure (CPC) of Moldova with a new article referring to submission of documents through the Programme of integrated case management (PIGD). As such, applications for legal action, call of appeal, recourse, revisions, court orders and any other claim or procedural act may be filed within court through PIGD, which is unique to the whole judiciary system in Moldova.
The provisions on circulation of procedural documents throughout Programme of integrated case management PIGD will come into force once conditions for implementation have been established. The Government will adopt the necessary normative acts to implement amendments within 12 months.
