Chisinau, 22 February /MOLDPRES/- The Constitutional Court ruling that the financial stimulation of the traffic police officers was declared constitutional will be published in the Official Journal of Moldova on 23 February.

The notification on controlling the constitutionality of the decision, which provides for the quarterly stimulation of the founding agents with bonuses amounting to 25 per cent of the amounts of the fines, was submitted to the court by Socialist MP Vladimir Odnostalco. He claimed that the government’s decision violates an article in the Constitution.

After examination, the court noted that the investigating officers within the General Police Inspectorate, having a special status with specific rights and obligations and given the existence of risk factors in their activity, are not in identical situations with other categories of public prosecuting agents.

The court pointed out that although the contested provisions set the quarterly financial stimulation of the investigating agent within the General Police Inspectorate of 25 per cent of the fines collected to the state budget, if the report on contravention is canceled by the court, the investigating agent will not get the amount.

Thus, the court ruled that in case of abuse of the founding agents in setting contravention fines, the reports can be appealed to the court, which according to the Contravention Code has the full competence to establish the guilt of the person in whose regard the contravention process was initiated.  

The court’s decision is final and cannot be subject to any appeal.
