Moldova's employer intending to make collective dismissals obliged to inform employees by 30 days earlier

Chisinau, 22 February /MOLDPRES/ - The employer who is set to make collective dismissals is obliged to inform employees and the Labour Force Employment Agency by at least 30 days ahead of the starting of the dismissal activities, according to legislative amendments approved by the cabinet today.
Under the document, the employer who intends to carry out collective dismissals is obliged to initiate consultations with employees’ representatives on possibilities to avoid collective dismissals or reduce the number of wage earners hit. Also, decision-makers will discuss possibilities to mitigate the consequences of the dismissals by resorting to social measures of support, such as the redistribution and requalification of employees dismissed.
Also, the employer will inform in written form employees’ representatives on: the reasons for the dismissals; number and categories of employees concerned; the period during which the scheduled dismissals will take place; criteria of selecting the employees who are to be dismissed and the way of allowances’ calculation.
At the same time, the trade union body or employees’ representatives will provide the needed support to the employer and employees as concerns the carrying out of the procedures dealing with the collective dismissals and possible re-employment.
The document also stipulates that the Labour Force Employment Agency will use the previous period to the dismissals, in order to provide assistance for the employment of the employees who are to be dismissed, by presenting to them opportunities of employment and requalification.
The legislative amendments are to be submitted to parliament for adoption.
