Justice Ministry unveils new Administrative Code of Moldova

Chisinau, 21 November /MOLDPRES/ - The Administrative Code of Moldova, worked out in Moldova for the first time ever, due to enter into force on 1 April 2019, was unveiled by the Justice Ministry at a news conference today.
The code comprises 258 articles, structured in three books, in which all present legal regulations dealing with the administrative procedure carried out by the public authorities are systematized. The code determines the legal status of the participants in the administrative relations, powers of the administrative public authorities and law courts in charge of considering administrative litigations, rights and obligations of the participants in the administrative procedure and the procedure of contentious administrative matters. Also, the adoption and launch of this code provides for the specialization of administrative judges.
Justice Minister Victoria Iftodi voiced confidence that the administrative jurisdiction would create the system and will have the best capacity to reconcile the public power and the rule of law state. “Only a good knowledge of administration can produce a balanced jurisprudence,” Victoria Iftodi stressed.
President of the Supreme Court of Justice (CSJ) Ion Druta said that the document would create new conditions for strengthening the rule of law state, in order to enhance the degree of guaranteeing the juridical security and accessibility of law.
President of the Constitutional Court Mihai Poalelungi said that the adoption of the code was particularly important for Moldova, as neither the law existing before 2000 nor the present law give possibility to have clarity in considering administrative matters.
Over 70 representatives of the three power branches – legislative, executive and judicial, as well as experts from Germany participate in the conference.
The event will be followed by a string of practical training seminars for the enforcement of the Administrative Code, organized by CSJ and the German Foundation for International Legal Cooperation (IRZ). The seminars will be meant for administrative judges, civil servants of the local and central public authorities and lawyers specialized in administrative matters.
