Chisinau, 3 May /MOLDPRES/- Decision on the objection of unconstitutionality of some provisions of Article 5 of Law 188 of 10 July 2008 on amnesty in connection with declaration of 2018 as the Year of Youth was published in the Official Journal of Moldova today.
The Constitutional Court confirmed the constitutionality of the amnesty of women with children aged up to eight years and decided that the provision cannot be extended to fathers, as statistics show that male detainees are about 95% more than female.
Under the decision, granting amnesty to all fathers of children aged up to eight years, including those who have committed serious crimes, would imply the release of a large number of prisoners, which could create a feeling of anxiety about public safety among citizens.
Under these circumstances, the court found that it would be very difficult for parliament to release fathers on the same grounds as in the case of mothers. Thus, the release from imprisonment of only women who have children aged up to eight years, and not men, is based on an objective and reasonable justification.
